CUSTOM - GRASSROOTS ALTERNATIVE TO ILLEGAL STREET RACING PROGRAM:

Stage 2: Design, Implement, and Promote Community Inclusion Programs.

ESTABLISHING THE NEED:

Unfortunately problems related to illegal street racing are not isolated to just the participants.  Going beyond the damage to the participants (personally/property) the impact of the activity is a detrimental burden shared with the community. The most documented effect on a community is an illegal street accident that results in innocent bystanders being injured or killed. The grief of an innocent life being abruptly taken doesn’t end at the accident scene rather it affects the families/friends for decades thereafter. Furthermore, the financial implications of an illegal street racing accident resulting in a fatality is at a cost of 2.7million dollars (2001 - CHP). The cost of repayment is mutually shared between the entire community through claims paid through insurance (Health, Life, and Auto) and the salaries of state services (Response Team: Police, Fire and DOT: highway workers). Also, there are many crimes related to illegal street racing that impact the peace of community ranging from noise complaints, theft, defamation of property, to insurance fraud.

Furthermore, as illegal street racing attracts a variety of participants, range of economic status, random locations, varying race distances, and unpredictable occurrences law enforcement is at a great disadvantage in eradicating the problem by themselves. Short of having a police officer at every other corner other alternatives need to be explored to reduce illegal street racing.

Evo specializes in increasing the overall effectiveness of our programs through a broad scope as we deal with factors both internal and external to a community. With community support Evo is able to maximize the response to the illegal street racing problem thereby creating a synergy of success.

Resolving Illegal Street Racing is not like the movie quote from the Field of Dreams "If you build it he will come." Although essential, it takes more than creating and encouraging safe and legal motorsports event (Stage 1) to effectively reduce the problem. As such in Stage 2 Evo Street Racers has created a support network through identifying the five major organizations in a community that can exert influence over the decisions of illegal street racing including educational institutions, the public, law enforcement, commerce, and the media.

Educational Institutions: Drivers Education

Cars have become faster, roads are more congested, highway speeds have increased, and traffic laws have changed; however, most driver educations programs have not changed. The unconditional pursuit of outdated drivers education programs have been at the cost of young adults lives and the peace of communities. As a society we cannot expect what we do not teach. Current drivers education have proven ineffective in addressing the needs of a new generation of young adults and must be changed.

Evo Street Racers works with educational institutions, insurance companies, and parents across the world to adopt a cohesive unified strategy on drivers education that focuses on the conditions of modern day driving, driver accountability, the consequences of poor decisions, and value in pursuing racing on the track versus on the street. Evo has proven that with the adoption of new concepts and expansion of drivers education programs can result in a comprehensive change in the social behavior of young adults towards illegal street racing.

Public: Neighborhood Watch

It is not okay to illegally street race nor is it okay to dismiss the activity without taking action. The public recognizes that Illegal Street Racing is a crime; however, often do not take action when they see the act being committed. Whereas many crimes will go reported there is often a lapse in reporting illegal street racing. This behavior must be changed.

We can't expect what we don't enforce. As a community we must not only state illegal street racing is a very dangerous crime but we must also take action against it. The public must be responsible for identifying the act, documenting essential information (licence plate, color-make-model of car, driver description, etc) and notifying the appropriate authorities in a timely manner. The very technologies that Illegal Street Racing utilize to elude police officers, such as cell phones, can act as the very method that they are reported. If possible the public should engage in community surveillance where in addition to reporting the activity it is filmed. The film can be provided to law enforcement which may result in arrest warrants, court orders, or at a minimum assist in law enforcement prioritizing the activity.

Evo Street Racers provides educational programs for the public that assist in discerning the characteristics of an illegal street race, the necessary description to report the act, and methods that the community can petition public officials to take action.

Law Enforcement: Outreach Program

Police and illegal street racers historically have been viewed each other with negativity. Yet most illegal street racers would agree to race on a track should it meet there needs and police officers would much rather direct them onto the track then write citations or respond to there accidents. In an effort to overcome the perceived adversity between police officers and illegal street racers while creating positive relations Evo Street Racers has created the "Evo Track Ticket."

The ticket, given by police officers exclusively, is redeemable for one free admission and tech card into a participating motorsports track. In return for accepting the "Evo Track Ticket" the person must sign the citation pledging that s/he will never participate in illegal street racing. One copy is retained by the police agency, the second copy is retained by the person, and the third copy is provided to the race track as admission. The ticket is used as a vital tool for police agencies to interact with illegal street racers in a positive manner, educate them in the dangers of activity, and notify them to alternatives. The open dialogue allows for an interpersonal relationship between the two parties as an understanding and respect is created resulting in a reduction of illegal street racing.

The ticket has been utilized in a variety of methods:

  • As an alternative to citing an illegal street racer with a traffic penalty, a warning is written along with an Evo Track Ticket.
  • As an alternative to citing an illegal street racer for trespassing (Hanging out in a parking lot after hours), a warning is written along with an Evo Track Ticket.
  • Without an traffic infraction the ticket is used as a method for law enforcement to approach high risk young adults that may be considering illegal street racing and offer the Evo Track Ticket.
  • The driver is cited for a traffic/trespassing ticket and provided with an Evo Track Ticket.

Local commerce is directly responsible for the economic health of a community and can provide substantial monetary assistance in the creation of programs and events that assist illegal street racers into motorsports racers. Through Evo's proven programs Corporate Responsibility is met with an viable economic stream where the return on investment is great enough to result in a sustained participation.

Stage 3: Lobby for Stricter Penalties, Effective Legislation, & Consistent Law Enforcement Techniques.

Once safe and legal alternatives to illegal street racing have been created (Stage 1) and a support network has been designated (Stage 2) Evo Street Racers lobbies for stricter penalties, effective legislation, and consistent law enforcement techniques. Historically weak and poorly enforced illegal street racing laws have presented the wrong image to our youth.  Weak laws convey the message that public officials don’t consider illegal street racing dangerous enough to enact laws that would impose significant penalties to the participants.   

Penalties:

Evo Street Racers supports stricter penalties that result in a lower incidence of illegal street racing through the consequences of participation.

Penalties may include:

  • First Time Offenders:
    • Charged with a Misdemeanor
    • Vehicle impounded for a period of 60 days at a minimum cost of $3,000 and storage penalties.
    • Jail Time 6-18 months
    • Suspension / Restriction of Licence up to one year
    • Maximum Fines $2,500 - $5,000 Plus Penalties
    • Mandatory 200 hours of community service
    • Mandatory Drivers Educations Course
    • Restriction on plea bargaining
  • Second Time Offenders:
    • Charged with a Misdemeanor and up to a Felony
    • Vehicle permanently seized.
    • Jail Time 12 - 30 months
    • Suspension / Restriction of Licence up to two years
    • Maximum Fines: $5000 - $7500 Plus Penalties
    • Mandatory 300 hours of community service
    • Mandatory Drivers Educations Course
    • Restriction of plea bargaining
  • Offenders Assisting An Illegal Street Race:
    • Charged with a Misdemeanor
    • Maximum Fines $1500 - $3000 Plus Penalties
    • Mandatory 100 hours of community service
  • Spectators or Passengers:
    • Maximum Fines $1000 - $2000 Plus Penalties
  • Illegal Street Race Resulting in Fatality:
    • Charged with a Felony: Second degree murder
    • Jail Time 6-20 years with 20-25 years of probation
    • Restriction on plea bargaining
  • Emission/Smog Businesses:
    • Any emission or smog business found to issue false certificates for modified vehicles that do not meet state and federal requirements is subject to a civil penalty of up to $25,000 per incident and suspension of business license for 6-36 months.
  • Service Repair/Tuning Centers
    • Any service center found to remove or install a component which defeats, bypasses, renders inoperative, or exceeds the mandated parameters of a emission control device on a motor vehicle registered for street usage is subject to a civil penalty of up to $25,000 per incident and suspension of business license for 6-36 months.

Legislation:

Evo Street Racers lobbies for legislation, ordinances, and laws that are standardized and comprehensive with the support the community, law enforcement, public officials, and city prosecutors.

Legislation may include:

  • A driver caught speeding 35 mph above the posted speed limit can be cited for illegal street racing.
  • A driver can be cited for illegal street racing without the need of engaging another vehicle.
  • Utilization of video tapes of illegal street races to pursue court orders for arrest warrants and vehicle seizures.

Enforcement Techniques:

Consistent law enforcement techniques with standardized citations and universal terminology will better assist in deterring the problem and develop a statically accurate system that can identify trends and efforts to reduce the problem.

  • Assign a higher priority to Illegal Street Racing cases in the Court system.
  • Adopt a common term on citations to categorize the activity of illegal street racing.
  • Define a universal definition for the act of illegal street racing.
  • Petition for increased Police funding on strategic enforcement projects.
  • Create a dedicated law enforcement teams that focus specifically on reducing the activity.
  • Request businesses to post no trespassing signs and allow law enforcement to enforce them.
  • Installation of speed humps (not speed bumps) and barricades in areas known for illegal street racing.
